DEPUY ASR LITIGATION

These lawsuits follow the August 2010 recall of the DePuy metal-on-metal ASR XL Acetabular Hip Systems and ASR Hip Resurfacing Systems.
All cases filed in federal court are now part of the federal multidistrict litigation (MDL).  The DePuy MDL litigation has been assigned to the Hon. David A. Katz in the United States District Court for the Northern District of Ohio.  Judge Katz will handle all pretrial proceedings.  The cases were transferred to Judge Katz to avoid duplication of discovery, to prevent inconsistent pretrial rulings, and to conserve the resources of the parties, attorneys, and the courts.  The cases are expected to go to trial in the courts where they were originally filed.   
All DePuy ASR hip systems cases filed in California state courts have been deemed complex and, like the federal cases, will be coordinated for pretrial purposes to avoid duplication of discovery, to prevent inconsistent pretrial rulings, and to conserve the resources of the parties, attorneys, and the courts.  The coordinated cases will be heard in the San Francisco Superior Court before the Hon. Richard A. Kramer.  Like the federal cases, these coordinated California cases are expected to go to trial in the courts where they were originally filed.

DEPUY PINNACLE LITIGATION

The DePuy Pinnacle hip implant has not been recalled.  However, like the recalled ASR device, the metal-on-metal Pinnacle hip implants are causing harm to a large group of recipients.   

The DePuy Pinnacle lawsuits are now part of federal multidistrict litigation (MDL).  The DePuy Pinnacle MDL litigation has been assigned to the Hon. James E. Kinkeade in the United States District Court for the Northern District of Texas.  Judge Kinkeade will handle all pretrial proceedings.  The cases were transferred to Judge Kinkeade to avoid duplication of discovery, to prevent inconsistent pretrial rulings, and to conserve the resources of the parties, attorneys, and the courts.  The cases are expected to go to trial in the courts where they were originally filed.
