DePuy Litigation

Litigation against DePuy Orthopaedics, Inc., Johnson  & Johnson, and related entities and individuals is currently underway in state and federal courts across the nation because of the harm caused by the defective DePuy ASR and DePuy Pinnacle metal-on-metal hip implants.

Contact Gomez Iagmin Trial Attorneys, regardless of whether you are currently having symptoms, and we will help you determine what type of hip implant you have and what rights you may have under the law.

DEPUY ASR LITIGATION

These lawsuits follow the August 2010 recall of the DePuy metal-on-metal ASR XL Acetabular Hip Systems and ASR Hip Resurfacing Systems.  All cases filed in federal court are now part of the federal multidistrict litigation (MDL).  The DePuy MDL litigation has been assigned to the Hon. David Katz in the United States District Court for the Northern District of Ohio.  Judge Katz will handle all pretrial proceedings.  The cases were transferred to Judge Katz to avoid duplication of discovery, to prevent inconsistent pretrial rulings, and to conserve the resources of the parties, attorneys, and the courts.  The cases are expected to go to trial in the courts where they were originally filed.  All DePuy ASR hip systems cases filed in California state courts have been deemed complex and, like the federal cases, will be coordinated for pretrial purposes to avoid duplication of discovery, to prevent inconsistent pretrial rulings, and to conserve the resources of the parties, attorneys, and the courts.  The coordinated cases will be heard in the San Francisco Superior Court before the hon. Richard A. Kramer.  Like the federal cases, these coordinated cases are expected to go to trial in the courts where they were originally filed.

Currently the lawyers and leadership in these cooperating jurisdictions are working for the benefit of the 35,000 United States patients who have this recalled medical device.  We have reviewed some 50 million pages of documents that have been produced and have taken over 50 depositions.  At this time we have a significant number of trials set with the company and we are primarily focusing our efforts on trial preparation.  The first case will start in Los Angeles on Tuesday, January 23rd before Judge Czuleger.  It is on behalf of our very own Plaintiff Loren “Bill” Kransky.  Mr. Kransky is a Montana resident and a Vietnam veteran.  We were able to obtain an early trial date for Mr. Kransky because of his failing health.  For daily updates on the progression of his case, please visit our Blog.

John Gomez and Theresa Bowen of Gomez Iagmin Trial Attorneys are working together with esteemed co-counsel from Panish, Shea & Boyle, LLP and Walkup Melodia Kelly & Schoenberger.  The case has already begun to receive significant media attention.  Please see the below links on articles regarding the DePuy litigation, as well as Courtroomview.com, which offers online video of the Kransky trial should you wish to view some or all of the case.  The case is expected to last approximately four weeks.

DEPUY PINNACLE LITIGATION

The DePuy Pinnacle hip implant has not been recalled.  However, like the recalled ASR device, the metal-on-metal Pinnacle hip implants are causing harm to a large group of recipients.

The DePuy Pinnacle lawsuits are now part of the federal multidistrict litigation (MDL).  The DePuy Pinnacle MDL litigation has been assigned to the Hon. James E. Kinkeade in the United States District Court for the Northern District of Texas.  Judge Kinkeade will handle all pretrial proceedings.  The cases were transferred to Judge Kinkeade to avoid duplication of discovery, to prevent inconsistent pretrial rulings, and to conserve the resources of the parties, attorneys, and the courts.  The cases are expected to go to trial in the courts where they were originally filed.
